By accessing this website, enrolling in a course, or using any content or services provided by Caitlin Winner, you agree to the following Terms of Service (“Terms of Service” or “Terms”) and our Privacy Policy. If you do not agree, please do not use this site or its content.
Scope of These Terms
These Terms of Service apply to all websites, subdomains, courses, content, and services operated by Caitlin Winner, including but not limited to caitlinwinner.com, courses.caitlinwinner.com and any Kajabi hosted course platforms or subdomains. These Terms apply to all visitors, users, and students, whether registered or unregistered.
Educational Purpose
All courses, workshops, videos, lectures, and materials are provided for educational and informational purposes only. Participation does not guarantee artistic, financial, or professional results.
Use of Images and Copyrighted Materials
This site and its courses may include images of artworks by historical, modern, or contemporary artists.
Images are used for educational, critical, and commentary purposes, including instruction, analysis, and historical context. Some works may be in the public domain, used with permission when available, or used in accordance with fair use principles under U.S. copyright law.
No ownership is claimed over any third party artwork displayed.

Intellectual Property and License
All original content provided by Caitlin Winner, including videos, lectures, slides, written materials, demonstrations, and course structure, is protected by copyright and other intellectual property laws.
When you purchase or access a course, you are granted a limited, non-exclusive, non-transferable license to access the materials for your personal educational use only.
You may not copy, reproduce, distribute, share, sell, sublicense, record, screenshot, or publicly display course materials, in whole or in part, without prior written permission.
Student Artwork License
Students retain full ownership of all artwork or materials they create (“Student Artwork”). By participating in a course, you grant Caitlin Winner a worldwide, non‑exclusive, revocable, royalty‑free license to use, reproduce, display, distribute, and share Student Artwork solely for educational, promotional, and marketing purposes, including on the website, in course materials, newsletters, and social media platforms.
This license is solely for purposes related to the studio’s courses, community, and outreach, and does not transfer ownership of the Student Artwork.
Students who prefer not to have their work shared publicly may opt out at any time by emailing hello@caitlinwinner.com. Opting out will not affect course access or participation.
Student Responsibility
Students are responsible for how they apply techniques, references, and ideas taught in courses. Caitlin Winner does not provide legal advice regarding copyright, licensing, or fair use related to student artwork.
Students are encouraged to create original work and to understand copyright laws applicable to their own practice.
No Guarantees
Artistic growth is subjective and depends on many factors including time, effort, experience, and individual circumstances. No guarantees are made regarding outcomes, skill development, exhibitions, income, or professional success.
Assumption of Risk
Participation in painting, drawing, or studio activities involves inherent risks, including physical strain or exposure to art materials. You assume full responsibility for your safe participation and agree to maintain a safe workspace.
Limitation of Liability
To the fullest extent permitted by law, Caitlin Winner shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this site, courses, or materials.
To the maximum extent permitted by applicable law, the total liability of Caitlin Winner for any claim arising out of or related to these Terms, the website, or any course or content shall not exceed the amount you paid to Caitlin Winner in the twelve months preceding the claim.
This includes, but is not limited to, issues such as service interruptions, data loss, access delays, and platform failures.
Indemnification
You agree to indemnify and hold harmless Caitlin Winner from any claims, damages, losses, or legal expenses arising from your use of the site, your artwork, or your violation of these Terms.
Nothing in these Terms is intended to limit any rights you may have under applicable New York consumer protection laws.
Accessibility
Caitlin Winner is committed to making this website and its content accessible and usable for as many people as possible. Third-Party Platforms
Courses may be delivered through third-party platforms, including Kajabi. Your use of those platforms is also subject to their respective terms and policies, in addition to these Terms of Service.
Refund Policy
Unless otherwise stated at purchase, refunds are available within 7 days of purchase. All refund requests must be sent to hello@caitlinwinner.com.
Changes to These Terms
These Terms may be updated from time to time. Continued use of the site or courses constitutes acceptance of any revised Terms.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
Venue
Any legal action or proceeding arising out of or related to these Terms or the use of this site or courses shall be brought exclusively in the state or federal courts located within Columbia County, New York, and you consent to the personal jurisdiction of such courts.
